General Terms and Conditions – Maeve & Niamh

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Withdrawal Period – The time period during which the consumer may exercise the right to withdraw from the contract.

  • Consumer – A natural person who is not acting for business purposes and who enters into a distance contract with the trader.

  • Long-Term Agreement – A distance contract concerning a series of products and/or services whose delivery or execution occurs over time.

  • Right of Withdrawal – The consumer’s right to withdraw from a distance contract within a specified period.

  • Trader / Business Owner – A natural or legal person offering products and/or services remotely to consumers.

  • Distance Contract – A contract concluded within an organized system of distance selling conducted by the trader, using one or more means of remote communication up to and including the moment the contract is concluded.

  • CESOP – Central Electronic System of Payment Information, implemented by the EU to monitor payment service providers.

Article 3 – Scope

These General Terms and Conditions apply to every offer made by the trader and to every distance contract concluded between the trader and the consumer.
Before entering into a contract, these Terms will be made available electronically or otherwise in an appropriate form.

By placing an order, the consumer acknowledges having read and accepted these Terms and Conditions.


Article 4 – Offers

All offers are non-binding. The trader reserves the right to modify or withdraw them.
Each offer clearly states the total cost, including shipping fees, customs duties, and any additional delivery or clearance charges where applicable.
Product images and descriptions are illustrative; minor variations in color or design may occur due to lighting or screen differences.


Article 5 – Conclusion of Contract

A contract is deemed concluded once the consumer accepts the offer and fulfills the specified conditions.
The trader will confirm acceptance of the order by email without delay.
If a product is unavailable after ordering, the consumer will be informed promptly, and any payment will be refunded within 14 days.


Article 6 – Right of Withdrawal (EU Consumer Rights Directive)

The consumer has the right to withdraw from the contract within 14 calendar days of receiving the product, without providing any reason.
To exercise this right, the consumer must inform Maeve & Niamh in writing (by email) before the withdrawal period expires.

The cost of returning the product is the responsibility of the consumer.

Exceptions to the right of withdrawal include:

  • Custom-made or personalized products

  • Intimate or hygiene items (e.g., underwear) if the seal has been broken


Article 7 – Costs and Refunds in Case of Withdrawal

The trader will refund all payments received, including standard shipping costs (if applicable), within 14 days of receiving the returned goods, provided that the product is returned undamaged and in its original condition.
Refunds will be made using the same payment method used for the original transaction.


Article 8 – Customs, VAT, and Import Duties

For orders shipped outside Ireland, the customer is responsible for complying with all import regulations of the destination country, including customs duties, taxes, and clearance fees.
The trader does not act as a registered importer.
Any additional customs or postal handling fees are borne by the customer.

Maeve & Niamh provides the necessary shipping documentation but cannot guarantee that products meet all local import requirements.
We recommend checking local import conditions before placing an order.


Article 9 – CESOP Compliance

As part of the EU CESOP (Central Electronic System of Payment Information) framework, payment service providers are required to record and report certain cross-border payment data.
Maeve & Niamh complies with all applicable CESOP obligations and ensures that relevant transactions are reported in accordance with EU law.


Article 10 – Conformity and Warranty

The trader guarantees that delivered products comply with the contract and applicable Irish and EU legal standards.
Any defects must be reported in writing within 14 days of discovery.
Products must be returned in their original packaging and condition.

This warranty does not cover:

  • Normal wear and tear

  • Damage caused by misuse, negligence, or improper handling

  • Damage caused by failure to follow care instructions


Article 11 – Delivery

Orders are typically processed and shipped within 30 days, unless otherwise agreed.
In case of a delay, the consumer will be notified within 14 days of purchase.

The customer acts as the recipient and importer of record.
While Maeve & Niamh ships according to international standards, we are not liable for delays, customs inspections, or postal disruptions.
Failure to meet import obligations does not entitle the customer to cancel or refund the order.


Article 12 – Complaints Procedure

Complaints must be submitted in writing to info@maeveniamh.com within 7 days of discovery.
The trader will respond within 14 days of receiving the complaint.
If a longer response time is necessary, the customer will be informed of the expected resolution period.

If the dispute cannot be resolved internally, consumers have the right to contact the European Online Dispute Resolution (ODR) platform:

Article 13 – Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Ireland and applicable EU consumer protection regulations.
Any disputes shall first be resolved amicably.
If no agreement can be reached, the dispute shall be submitted to the competent court in Dublin, Ireland.
